We also advise hospitals on a full suite of other legal matters, such as physician recruiting; hospital-based physician contracting; Medicare billing rules; on- and off-balance-sheet real estate financings for medical office buildings; tax-exempt bond compliance; managed care and value-based care contracts; bundling arrangements; and regulatory counsel, including Stark law, fraud and abuse, HIPAA, EMTALA, and labor and employment advice.

Bradley is a partner with hospital systems both with and without significant in-house legal counsel. For clients without in-house counsel, we serve as general counsel by providing day-to-day legal support for all aspects of the healthcare organization. To maintain impeccable, responsive service, we create extranet sites to track legal matters and communicate effectively with our clients. For clients that do have their own in-house legal departments, we work collaboratively with their attorneys to share our knowledge of technical regulatory questions, offer “second opinions” on difficult issues, and provide extra capacity to tackle larger health law matters.

As a testament to our abilities, we currently are the primary outside counsel for one of the largest publicly traded hospital companies in the United States, which owns, operates, or leases approximately 160 acute care facilities in 22 states, along with countless physician practices, surgery centers, and joint ventures. Our lawyers also serve as the primary legal counsel for the largest nonprofit hospital system in middle Tennessee, consisting of eight acute care hospitals, a specialty hospital, numerous surgery centers, outpatient imaging facilities, specialty facilities, physician practices, and related service lines.

In addition to the clients such as these for which we are primary legal counsel, Bradley also routinely represents many other for-profit and nonprofit hospital systems on various matters. These other hospital clients range from large, publicly traded companies to local nonprofit systems, and include a children’s hospital, an academic medical center, and multiple regional hospital systems.
