Michael Knapp, partner in the Charlotte office, was a speaker at the 2011 ABA Annual Meeting "I Can See for Miles: Cutting Edge Tools for Construction Practitioners".  He discussed how consultants are utilized in most construction disputes. The information exchanged between lawyer, client and consultant can be privileged to a certain extent. The session provided drafting techniques on how to structure the consulting agreement to maintain the privileges, and practical tips on how to manage the flow of information so that privileges are not inadvertently breached.
