B. David Joffe and Andrew Elbon, partners in the Nashville office, will be presenting a course entitled "An Update on Retirement Plan Fee Disclosure and Fiduciary Obligations".
This course will provide an overview and update on the Department of Labor service provider and participant fee disclosure requirements for retirement plans. It will cover who is required to provide the disclosures, what disclosures are required, when the disclosures must be provided (and reviewed), how the disclosures must be provided, and why the disclosures matter. The course will touch on fiduciary obligations including the obligation to evaluate the disclosures to avoid a prohibited transaction. The discussion will also include a review of recent reach of fiduciary duty cases and steps employers can take to limit their liability.
