Entity or Owner? Varying State Approaches to Taxing Pass-Through Entities and Their Owners

Partnerships and LLCs in multi-tiered structures have become common in the corporate organization chart. This panel will identify and explain the various approaches states use in taxing passthrough entities, including direct taxation of the entity, nonresident withholding, information /composite reporting, consent to state taxation and inclusion of the entity in a combined return. Corporate state income tax problems, traps for the unwary and opportunities that these structures create will also be discussed.
