In 2016, the Department of Justice and whistleblower plaintiffs continued to reap significant False Claims Act successes, with over $4.7 billion in settlements and judgments. Industries such as health care, government contracting, and financial services were among the main targets. In addition, 2016 saw a landmark Supreme Court decision in Escobar, major changes in FCA per-violation penalties, and a renewed DOJ focus on individual liability. Early returns in 2017 suggest these trends will continue and courts will wrestle with other hot issues, including statistical extrapolation, application of Escobar’s materiality standard, and others.
