The Clean Water Act Reaches Groundwater: The Newest Frontier for Citizen Suit Litigation

Federal courts have ruled that small discharges of pollutants that reach waterbodies through groundwater can trigger Clean Water Act liability. These “hydraulically connected discharges” threaten to increase citizen suit liability significantly.
