Deciding whether or not to include a binding arbitration clause in a commercial contract, or agreeing to binding arbitration over court when a dispute arises, is a significant business decision for any business and in-house counsel. This presentation will include a “debate” over the pros and cons of binding arbitration which will illuminate the factors that any in-house needs to consider when making such a decision.
