No More Two-Step in the Fifth Circuit: “Similarly Situated” Means what it Says in FLSA Collective Actions

The program will evaluate the current manner in which most district courts determine whether notice should be sent in collective actions, with a focus on the new Swales holding in the Fifth Circuit that eliminated preliminary certification, how it came about, and what types of cases it likely will and will not impact in the future.
