In Compliance: Are We Advocates or Compliance Officers? Understanding the Implications of the Recent High Profile Recall Investigations and Recommendations for Inside and Outside Counsel

In May 2014, a report disclosed to Congress related to recalls in the automotive arena included, among other things, nine recommendations for company lawyers. These recommendations arguably sought to transform in-house and outside counsel into compliance officers and the consequences of this report will inevitably extend to industries beyond the automotive arena. This panel discussion will provide valuable perspectives from both in-house and outside counsel regarding (1) the potential implications of the recommendations; (2) the communication of legal risk to business units; (3) the preservation of the attorney-client privilege through investigations, business advice, and litigation; and (4) best practices.
