Anne Knox Averitt of the Litigation and Labor and Employment Practice Groups, was recently quoted in a Law360 article entitled “Lawyers Weigh In On High Court's Recess Appointment Ruling” which explores the significance of the Supreme Court’s recent ruling in National Labor Relations Board v. Noel Canning.

“In broader terms,” Anne Knox explains, “the ruling means that while the president can make a recess appointment without Senate confirmation, either the House or the Senate can block a recess appointment by ending a Senate recess and implementing a ‘pro forma session’.” She added, “This could pose a significant barrier to presidential appointments if Republicans gain control of the Senate in November."
