Noel Canning.
“In broader terms,” Anne Knox explains, “the ruling means that while the president can make a recess appointment without Senate confirmation, either the House or the Senate can block a recess appointment by ending a Senate recess and implementing a ‘pro forma session’.” She added, “This could pose a significant barrier to presidential appointments if Republicans gain control of the Senate in November."
