Bill Norton was quoted in the Law360 article “Justices To Consider Restoring Ch. 11 Jurisdiction,” exploring the ramifications of a complex jurisdictional case, which is currently before the U.S. Supreme Court and will determine “which matters can be decided in Chapter 11 and which need an Article III court.” The decision could severely undercut the power of Chapter 11 Courts to decide fundamental bankruptcy disputes.
“If there’s no consent, and if that’s not a waivable thing, then you’ve got to go straight to a district court judge that’s not going to have the benefit of the bankruptcy court’s findings in advance,” Norton said. “That is just a tremendous obstacle to getting all of that accomplished, and that’s where there would be outrage if the Supreme Court would say that consent cannot be waived.”
