Partner Keith Covington Quoted in Law360 Regarding DOL’s Worker Misclassification Guidance
Labor and Employment attorney, Keith Covington was quoted in Law360 regarding the U.S. Department of Labor (DOL) new issued guidance on independent contractor classification interpreting Fair Labor Standard Act (FLSA) broad definition to cover most workers as employees.
“The DOL’s guidance makes clear that, in determining whether an employer’s workers have been properly classified as employees or independent contractors for purposes of the Fair Labor Standards Act, the DOL will apply an expansive 'economic realities' test in which the relevant inquiry is whether the workers are economically dependent on the employer or truly in business for themselves,” said Covington.
