Bruce P. Ely Quoted in Bloomberg BNA Regarding Alabama’s Chance to Defend Fuel Taxes in CSX Case

State and Local Tax (SALT) partner Bruce Ely was quoted in Bloomberg BNA Weekly State Tax Report regarding a fuel tax dispute between Alabama and railroad operator CSX.

The federal district judge who will hear the case on remand, Judge Abdul K. Kallon, already found the state’s tax scheme non-discriminatory once. However, that was a broad ruling that didn’t closely examine the tax treatment of trucking companies and water carriers, said Ely.

“I think the railroads should be a little more nervous about how he’ll rule this time,” said Ely. “This time, the judge is going to have to get a little deeper in the weeds, which I’m sure he will. He’s a brilliant jurist.”
