In a 100-day protest cycle, challengers have to convince the GAO not only that the contracting agency made a mistake, but also that the error clearly impacted the chances of winning projects that could run into the billions of dollars. Beezley explains that initial arguments—which need to carefully avoid a “kitchen sink” approach while still presenting enough arguments to force the agency to turn over the entire relevant administrative record—frequently change when that administrative record is handed over.

“That’s when sometimes it becomes clear that what you thought was one thing was actually another,” Beezley said.
