Bradley Arant attorney Aron Beezley was quoted in Law360 on taking bid protests to the U.S. Government Accountability Office (GAO). There are a number of arguments that should be avoided to have a chance at being among the few protests — just over 10 percent in fiscal 2015 — where the GAO favors the challenger on the merits. Among the arguments that attorneys should avoid is alleging bias, which incurs a higher burden of proof and falls into an area where the GAO is least likely to be sympathetic.
“You’re going to need some sort of smoking gun,” Beezley said of pursuing bias allegations.
