Bradley partner David Joffe was quoted in FiduciaryNews.com on the removal of ERISA protections for private employees using state-run retirement plans. Originally enacted in 1974, ERISA exempted state and federal retirement plans from the same funding requirements as private plans, since public plans were covered through regulation.
“State government employees participating in state government plans should generally have adequate protection under state laws,” explained Joffe. “State government sponsored plans do not have the same issues that could affect private employers operating in more than one state.”
