Bradley attorney Aron Beezley was quoted in Law360 on important litigation developments for government contractors so far in 2017. While the Supreme Court didn’t issue any major decisions involving government contracts this term, the impact of one of its most important recent decisions — the Escobar ruling — continued to be felt through the first half of the year.
The most widely debated issue has been materiality, with the high court ruling that false certifications cannot form the basis of an FCA claim unless “material” to the government’s decision to pay. On one hand, courts have broadly shown a willingness, based on a footnote in the high court’s ruling, to deal with the materiality issue on dispositive motions, explained Beezley.
“Procedurally, you’re seeing these questions come up more and more now through dispositive motions, and then the courts in turn are fleshing out the contours of the materiality rule when ruling on these dispositive motions,” he said.
