The U.S. Government Accountability Office (GAO) recently sustained a construction contractor’s bid protest after it determined that the procuring agency’s rejection of the contractor’s bid as nonresponsive was unreasonable. This case, W.B. Construction and Sons, Inc., is noteworthy because it illustrates that contractors whose bids are improperly rejected by procuring agencies are not without recourse.
