For 25 years, Paige Boshell has counseled financial institutions, creditors, and their service providers regarding a variety of federal and state regulatory issues related to all aspects of their operations. She regularly advises financial institutions regarding the delivery of commercial and consumer products and services through traditional channels and via the Internet and mobile devices. She has broad experience negotiating vendor and outsourcing contracts for various clients, and advises clients on information security protection, data breach response, and cyber-risk management.
Paige serves as team leader for the firm’s Cybersecurity and Privacy Team and its related Digital Services and Electronic Contracting Team and Cybersecurity and Financial Privacy Team.
Paige regularly drafts and negotiates a variety of third-party agreements for financial institutions and other clients including: FinTech; software licensing, software-as-a-service, hosted software and services, and cloud computing; core outsourcing; payment card processing, BIN sponsorship, co-branding and accounts receivable sales; joint development ventures; marketing and referral arrangements; hardware acquisitions; and confidentiality and non-disclosure.
She advises financial and non-financial clients regarding the delivery of products and services via the Internet, including website content, flow and architecture, and linking issues. Paige drafts numerous website terms and conditions, privacy policies, Internet and electronic contracting disclosures and agreements, employer Internet usage and email monitoring policies, and related employee disclosures.
Paige regularly counsels financial institutions and vendors regarding regulatory compliance issues. She drafts a wide variety of bank policies and procedures, such as CIP, privacy, FCRA, FDCPA, information security and codes of ethics, and retail agreements and disclosures, including signature cards, deposit agreements, TISA disclosures, credit card applications and agreements, home equity loan applications and agreements, check overdraft protection agreements, TILA disclosures, business credit applications and agreements, privacy policies and notices, FCRA notices, treasury management agreements, Check 21 agreements, central vault and night depository agreements, automated clearing house agreements, wire transfer agreements, EFT disclosures, and Internet and mobile banking applications and agreements.
Paige speaks regularly regarding cybersecurity issues in particular and cyberspace issues generally, both with respect to regulated financial institutions and non-regulated entities.
