Amandeep S. Kahlon

Aman is a seasoned construction litigator with experience representing owners, contractors, and subcontractors on projects built throughout the United States. He has helped clients successfully navigate disputes on a diverse array of projects, including embassies, hospitals, environmental clean-up and remediation of toxic sites, fossil fuel power plants, solar farms, and battery energy storage facilities. Aman devotes a substantial portion of his practice to power and energy work. In the renewable space, he has represented a number of large solar general contractors and developers on disputes with module suppliers, OEM providers, design firms, owners, and subcontractors.

Aman handles all types of traditional construction claims (e.g., breach of contract for delay, interference, acceleration, non-payment, defective design; breach of warranty; negligence; wrongful termination), as well as typical project administration issues (e.g., change order disputes, lien filings, permitting delays, payment and liquidated damage withholdings).

Representative actions include:

• $180 million breach of contract, design defect, breach of fiduciary duty, and negligence lawsuit in New Mexico state court brought against design-build contractor on a water diversion and treatment project.
• Multimillion-dollar arbitration for claims regarding defective design and negligence brought on behalf of battery energy storage contractor against design firm.
• $8 million arbitration in Canada for general contractor arising out of delay and acceleration claims against the owner on a solar farm.
• $40 million design defect lawsuit against subcontractor/vendor on international sales contract for military communications system brought in Ohio state court. 
• Several multimillion- dollar disputes on General Service Administration projects in Texas and Arizona against both the GSA and subcontractors.

In addition to his dispute work, Aman also regularly advises clients on contract reviews working opposite owners, contractors, subcontractors, and engineers alike. Aman has helped negotiate EPC agreements and design-build agreements for large, complex construction projects including solar power plants, self-storage facilities, office buildings, and hotels. He has also helped clients draft and revise their internal suites of contract and subcontract forms and frequently assists firm clients on revisions to standard AIA, DBIA, and other industry form agreements on a wide variety of projects. 

Outside of his construction practice, Aman enjoys volunteering his time for indigent clients and those in need. Some of his pro bono matters include litigating a prison abuse civil rights matter, representing an immigrant in her withholding from deportation and asylum proceedings, and assisting several service members in family law matters through the ABA Military Pro Bono Project.
