      We represented the mortgage servicer in this real estate litigation action involving a counterclaim and third party complaint brought by three mentally handicapped borrowers in a foreclosure action. Defendants’ counterclaims and third-party complaint (filed against their former attorney-in-fact,) included: alleged insufficient capacity to enter into a contract, unconscionability/unenforceability of the loan transaction, and undue influence/ duress at the time of entry into the mortgage transaction. Through Defendants’ counsel, The Cuyahoga County Board of Mental Retardation became involved in the case to ensure that their interests were protected. After extensive discovery, including deposition testimony of the three mentally handicapped borrowers, we were successful in reaching a settlement and dismissal.

      Saintsbury Holdings, LLC v. RMC, LLC et al., No. 1:06-cv-0014 (M.D. Tenn. 2007)

      Successfully tried a three-day bench trial in the United States District Court for the Middle District of Tennessee to remove a lien lis pendens filed against property owned by a Middle Tennessee golf course developer. After prevailing in the bench trial on behalf of the firm’s client, the plaintiffs dismissed their lawsuit without any recovery.

      We represented the developers who purchased a 40-acre tract upon which they subsequently built a multi-million dollar development with over 100 commercial tenants. The Plaintiffs alleged to previously own an easement through said development and sought demolition of the commercial development along with compensatory damages in diminution in value of their adjacent commercial development. After extensive discovery and expert witness testimony, the trial court granted the developers summary judgment which involved analysis of recorded instruments and whether they were easements, licenses and the ability to convey the same.

      Corporate governance dispute

      As a result of motions filed on behalf of the firm’s client, the court lifted a temporary restraining order and dissolved lien lis pendens. Thereafter, the court dismissed a number of the claims. The plaintiff then dismissed the remainder of the claims. At the conclusion of the case, the court awarded the firm’s client its attorneys’ fees and costs incurred in the action.

      Defense of site rezoning on behalf of Home Depot

      Represented Home Depot in the defense of the rezoning of a site for one of its largest retail facilities. The rezoning was preserved pursuant to a negotiated settlement.

Her role included coordination of the simultaneous closing on lands owned by 15 different entities, together with the termination of crop farm leases and the negotiation of new farm leases while the site is in the development stage.

      Real estate seller brought specific performance action against purchaser for failure to perform certain obligations under the contract, including compliance with state environmental regulations. Obtained rescission of the contract and a $1,000,000.00 judgment against the company and the individual owners following summary judgment.

      Counsel to the Ashford Hospitality REIT in connection with its ownership of the Renaissance Hotel in Nashville and its negotiation with the adjoining property owners in a major redevelopment of the former Nashville Convention Center.

      Representation of United Methodist Agencies

      Served as senior advisor to the United Methodist Publishing House in the sale of its seven-acre headquarters property, across from the Music City Convention Center, in four separate transactions, which included two sales to the developer of Westin and JW Marriott hotels.

      Zoning for Long Wall Coal Mining Operations

      Represented a long wall coal mine operator in securing a use variance for the installation of a Twin shaft ventilation system, necessary for the expansion and continuation of the mining operation. The approval was appealed by adjacent land owners to the State Circuit Court. The appeal was dismissed on a contested motion to dismiss.
