Represented oil and gas services company involved in an employee fatality caused by a defective piece of equipment. We conducted the accident investigation on client’s behalf, secured the defective piece of equipment over OSHA’s objections, prepared client’s witnesses for their OSHA interviews, and represented client company during the resulting OSHA inspection. We further represented our client at OSHA’s informal settlement conference and successfully obtained a reduced penalty and citation.
Represented full-service general contractor client specializing in heavy highway and civil work whose employee was injured in a trench cave-in. Client received 16 OSHA violations, including nine serious violations and six willful violations. OSHA assessed $423,000 in fines associated with those violations and placed client on OSHA’s “Severe Violator Enforcement Program.” As a result, this family-owned and operated business faced imminent closure. We successfully reduced willful violations from six to two and negotiated a decreased penalty down to $160,000 thereby preventing bankruptcy for the client.
