Bradley partner Alexis Buese was quoted in Bloomberg Law discussing the recent surge in cookie-banner lawsuits and the growing financial risk for website operators.
Buese said the biggest concern for companies is the scale of potential liability under California privacy law.
Claims under the California Invasion of Privacy Act can carry statutory damages of $5,000 per violation. “When you multiply that across a class, that’s a really significant exposure,” Buese said.
Buese explained the litigation trend is especially concerning because these cases are relatively easy for plaintiffs to investigate and file.
