Bruce Ely Quoted in Bloomberg Tax on Alabama's Remote Worker Tax Guidance

Bradley attorney Bruce Ely was quoted in Bloomberg Tax about the Alabama Department of Revenue’s guidance, issued in August, clarifying that employers should withhold Alabama income tax from a nonresident employee’s wages only to the extent those wages are attributable to services physically performed in Alabama.
Ely noted that Alabama was the only state with a judicially created convenience-of-the-employer doctrine.
“It was not good for Alabama businesses or anybody who had employees that were sort of skipping around the country,” Ely said.
He described the department’s clarification as helping to “get rid of the stigma” around Alabama’s previously perceived tax approach.
“That gives employers here in Alabama a good deal of certainty that they did not have a year ago."
