Aseracare Update: Insights into Objective Falsity in Litigation and Trials

Bradley Partner Jack Selden and fellow panelists will provide insights into developing and proving objective falsity and scienter in FCA litigation and trials at the upcoming ABA False Claims and Qui Tam Trial Institute. Using the recent Aseracare trial as its starting point, this panel will discuss:

• The background and procedural history of Aseracare
• Making the decision to try an FCA/Qui Tam case
• Effective litigation strategies in pretrial practice, discovery, and at trial

Jack served as lead attorney defending Aseracare from the inception of the False Claims Act investigation through both the trial and the 11th Circuit appeal, resulting in a landmark court opinion in 2019 favoring healthcare providers on the issue of medical necessity.
