During the pendency of IT consulting firm CAN SoftTech Inc.'s protest over a $1.5 billion procurement, the U.S. Department of Commerce took voluntary corrective action without asking for a formal remand from the court and without consulting the parties.
Beezley said the Federal Circuit's decision in this case could have significant repercussions for the bid protest community — particularly if it allows agencies, without telling the parties or without permissions from the GAO or the Court of Federal Claims, to conduct mid-litigation reevaluations — by shifting how agencies defend against big protests going forward.
“Ultimately, I think the Federal Circuit will say that agencies are not allowed to do that without looking for a formal remand because without the remand, the reevaluation corrective action is inherently unreliable because it's conducted in the heat of litigation and going to possibly be litigation motivated,” Beezley said.
