Bradley attorney Scott Zweigel was quoted in Law360 discussing whether it is too early to see the full impact of the major tort reform laws passed in Georgia.

Zweigel noted that many changes only took effect in April, meaning courts are just beginning to grapple with them. "Of course, they're going to play out in specific cases, in ways that the Court of Appeals and the Supreme Court are going to have to figure out how some of these statutes are applicable in various circumstances,” he said.

He is closely watching a reform that allows defendants to file a motion to dismiss instead of immediately answering a lawsuit and pauses discovery while a judge decides whether the case should proceed. “I just think it’s helpful to decrease costs and get rulings on dispositive motions potentially early on,” Zweigel explained.

Zweigel also flagged potential legal fights over split trials and a rule allowing judges to deny them in cases involving less than $150,000. He suggests the provision could prompt constitutional challenges because it treats cases differently based on dollar amounts. “There may be some kind of equal protection-related challenges with respect to the amount in controversy, and some arbitrariness in that provision,” he said.
