Aron Beezley Quoted in Law360 on Emerging Themes in 2026 Government Contracts Law

Bradley partner Aron Beezley was quoted in Law360 discussing the Department of Justice’s landmark $17 million False Claims Act settlement with IBM, which marks a major shift in enforcement priorities. According to Beezley, the government’s focus is not traditional procurement fraud but contractor certifications.

"Another thing is that compensation that's tied to demographic targets is pretty high risk now in light of this settlement, so a contractor's bonus structure that's key to hitting racial or gender numbers will draw immediate scrutiny by this specific administration. Relatedly, intent doesn't necessarily insulate you, so even well-intended DEI programs can still trigger liability if they functionally influence employment decisions based on protected characteristics," Beezley said.

Beezley explained the settlement is likely the beginning of a broader enforcement effort.

"Also, this case, I don't think it's a one-off. I think DOJ created a dedicated initiative, and we're probably going to see more cases come in like this," he said.

The IBM resolution was followed by another DOJ settlement with PayPal, reinforcing Beezley’s view that the government is building a broader enforcement campaign.

Beezley also pointed to the Federal Circuit’s decision in Syneren Technologies Corp. v. United States as an important clarification for bid protests.

"Now, that decision does not go so far as to say that agencies can add to or augment an evaluation record in order to defend against a protest, and that's something that we probably will see agencies try to do and try to rely on the Syneren case for, but I think that's stretching the Federal Circuit's decision too far," Beezley said.

Beezley cautioned contractors and agencies against overreading the decision.
