Bradley attorney Aron Beezley was quoted in Bloomberg Law on the growing use of AI in evaluating contractor proposals, which is prompting government contractor attorneys to rethink litigation strategy for challenging improper AI use in bid evaluations.

Beezley pointed out that before the September ruling, Judge Lerner had ordered the Army to produce AI-generated evaluations for the administrative record, after the government initially claimed those materials weren’t part of its decision-making process.

This development means protestors now “have a real tool” to force AI-related content into the protest record even when an agency denies relying on it.

Beezley also noted a well-established line of Government Accountability Office and U.S. Court of Federal Claims decisions holding that a protest can succeed when the agency record fails to show how evaluators reached a rating.

“If AI-generated drafting produces exactly that kind of unexplained, generic record a protestor does not even need to prove the AI caused an error — the documentation gap does the work,” he said.

Beezley characterized this as “actually the more dangerous exposure for agencies because courts are skeptical of after-the-fact explanations.”
