Jonathan Kolodziej Quoted in Inside Mortgage Finance on Mortgage Lenders Rolling Out AI Loan Officers Despite Unclear Rules

Bradley partner Jonathan Kolodziej was quoted in Inside Mortgage Finance explaining how AI can play a significant role in origination, but existing disclosure and licensing obligations effectively require a human, licensed loan officer to remain attached to each transaction.
Kolodziej said it’s unclear whether mortgages can be fully AI-originated while still complying with state and federal law.
On licensing, he noted that nothing specifically requires the technology itself to hold an independent license, but said matters get complicated once other legal obligations, such as disclosure requirements, are layered on top.
As an example, he pointed out that the closing disclosure and loan estimate require the name of a primary contact or individual loan officer.
He said the developing industry consensus is that a human, licensed loan officer will need to be assigned to every transaction and take on responsibility for it, even as AI-powered origination draws more interest.
