As a litigator, Bobby Poundstone frequently represents clients in litigation matters pending in federal and state trial and appellate courts. He is AV Preeminent Rated by Martindale-Hubbell® and has experience in both the courtroom and presenting oral arguments to the Alabama Supreme Court. Bobby is also a regulatory lawyer and routinely represents clients in matters pending before the Alabama Public Service Commission and other state agencies.

Bobby’s practice covers a wide variety of litigation matters and clients. For example, he routinely handles “bet the company” and other business litigation matters. Bobby has represented dot-com and e-commerce entities in various types of litigation. He successfully defended a challenge to a gas utility’s authority to conduct an LP gas business and successfully defended multiple electric cooperatives in patronage capital class action lawsuits pending in Alabama state courts. Bobby also represents a media company and its television stations in various litigation matters. He also has handled multiple litigation matters for construction companies and developers.

Bobby is recognized by The Best Lawyers in America® for Healthcare Litigation, including being named the “Lawyer of the Year” for Montgomery in that category for 2023. His healthcare work includes successfully defending a challenge to a Certificate of Need awarded to a hospital and handling litigation arising out of an agreement to purchase a mental health hospital. His healthcare-related practice also extends to medical malpractice defense and defending pharmaceutical companies and medical device manufacturers in products liability cases. 

Bobby regularly represents municipalities in litigation matters, including the defense of class action and other lawsuits bringing various constitutional challenges. He has represented tractor truck, automobile, lawn equipment and golf cart manufacturers in products liability, warranty, contract, and fraud cases.

As a regulatory lawyer, Bobby represents telecommunications, gas, water and transportation clients before the Alabama Public Service Commission and other state agencies. He regularly provides legal advice to these clients and other utilities, such as electric cooperatives, power generators, municipal utilities, and gas districts. The matters Bobby has handled before the Public Service Commission include obtaining a certificate of authority for an intrastate natural gas pipeline and securing the approvals necessary to effectuate a proposed merger and associated spinoffs of large telecommunications companies.

Bobby is an active member of various legal organizations. He is a graduate of the Alabama State Bar Leadership Forum and completed the ABA AP Leadership Program. Bobby currently serves as an Alabama Bar Commissioner and was recently elected to the Disciplinary Board of the Alabama State Bar. He is the Alabama State Delegate for the American Bar Association House of Delegates and serves on the ABA Nominating Committee. He has also served as a co-chair of multiple ABA Section of Litigation committees, including the Pretrial Practice and Discovery, Ethics and Professionalism and ABA Resource Committees. Bobby is a Fellow of the American Bar Foundation and member of the American Counsel Association.

Bobby is also an active and dedicated alumnus of Auburn University. A former national president of the Auburn Alumni Association, he has served as a member of the Auburn Alumni Association Board of Directors; as a member of the Auburn Trustee Selection Committee for 11 trustee seats; as an ex officio member of the Auburn Foundation Board; and as president of the Montgomery Auburn Club.

Bobby was born and raised in Montgomery and has been practicing law in Montgomery since 1999. Bobby’s wife, Katie, is also a Montgomery native, and they are the proud parents of two children, John and Claire.
