Home equity investment (HEI) products—including shared appreciation mortgages and home equity agreements—are increasingly under the microscope as lawmakers and regulators debate whether they should be brought under existing mortgage regimes or governed by new, product-specific rules. This webinar will provide a concise, high-level overview of the developing federal and state landscape, including Senate Bill 4803 (the proposed Home Equity Lending Integrity Act) and its effort to bring HEI products under TILA, as well as recent and proposed state actions in Connecticut, Maine, North Carolina, Pennsylvania, and Illinois.

We will examine how some jurisdictions extend traditional mortgage and consumer credit frameworks to HEI products while others are creating bespoke regulatory regimes with unique requirements such as counseling mandates, detailed disclosures, licensing obligations, and APR caps, and we will discuss the practical implications of this fragmented approach for multi-state providers, compliance teams, and product developers operating in an environment where no uniform standard is likely in the near term.
