Bradley attorney Alexis Gregorian was quoted in Clinician regarding the recent federal crackdown on fake nursing credentials.

Gregorian noted that when hospitals unknowingly employ “fraudulently credentialed nurses,” they expose themselves to significant liability, including claims of negligent hiring or negligence. “Entities that employ these individuals knowingly are at even greater risk of professional negligence claims but could also potentially face civil or even criminal liability for billing healthcare benefit programs for services purportedly rendered by these individuals knowing they did not have the requisite training to provide them,” she said.

She added that hospitals must strengthen their hiring and credential-verification practices, not only during onboarding but on an ongoing basis. “Eagle-eyed attention to inconsistencies like unexplained gaps between the graduation date on a licensee’s diploma and the date the licensee passed the NCLEX are key to the credentialing process.”

Gregorian also recommended that hospitals treat institutions associated with known fraud schemes as high risk and apply heightened scrutiny.
