Bradley attorney Jeff Harvey was quoted in Fortune emphasizing that even though the U.S. Supreme Court struck down the Trump administration’s tariffs, companies should not expect quick refunds.

The Supreme Court ruled that tariffs imposed under the International Emergency Economic Powers Act were unlawful because tariff authority belongs to Congress. If a lower court orders the government to repay the tariffs, the administration could challenge that order, potentially sending the dispute into another round of litigation.

“I was surprised since it was something previously raised by the Court of International Trade,” Harvey said.

Harvey noted that the Supreme Court’s ruling did not resolve the biggest question: how and when companies will get their money back. That uncertainty means businesses could face long delays and additional legal battles before any refunds arrive.
