This article addressed the Second Circuit’s August 2021 decision in In re Gravel, and the bankruptcy servicing implications.  Gravel held that the bankruptcy court did not have the authority to award punitive damages for the failure to file a notice of postpetition fees, expenses and charges pursuant to Bankruptcy Rule 3002.1.
