Will’s practice focuses on business litigation disputes in which he represents plaintiffs and defendants in matters tried in state and federal courts (including bankruptcy courts) or in arbitrated matters. He represents clients in matters related to breach-of-contract claims, breach-of-fiduciary-duty claims, business torts (including securities fraud and other transactional fraud), claims arising from disputes between partners or LLC members or from mergers and acquisitions, legal malpractice claims, claims related to trade secret misappropriation, and ultra vires claims against officers or directors.
Will’s cases typically involve transactions related to securities, real estate, oil and gas, private equity, healthcare, and intellectual property. Corporations and individuals have also retained him to defend them in federal white-collar criminal investigations and prosecutions conducted by the Department of Justice, Securities and Exchange Commission, and Environmental Protection Agency. Apart from his trial practice, Will has taken the lead in briefing and arguing cases before the Texas appellate courts, the Supreme Court of Texas, and the Fifth Circuit Court of Appeals.

Served as lead trial counsel for Global 500 company in matter where plaintiff sought approximately $20 million in recoveries through business-tort and breach-of-contract claims; obtained dismissal of key claims and damage theories and forced plaintiff to enter into confidential, nuisance-value settlement for approximately 1% of alleged damages. Co-led trial team prosecuting securities fraud claims against Global 500 multinational investment bank on behalf of family trusts and obtained favorable confidential settlement. Co-led team of five law firms representing board members for Delaware healthcare company defending themselves against claims for breach of fiduciary duty, fraud (including fraudulent transfer), and negligence, through which plaintiff, a bankruptcy trustee, sought approximately $160 million, and successfully argued for a full/final summary judgment for client and other board members.
