      Akima Intra-Data, LLC v. United States, COFC No. 14-378C (2014)
      Successfully represented the Intervenor-Awardee, ServiceSource, Inc., in a U.S. Court of Federal Claims bid protest involving the award of the National Geospatial-Intelligence Agency West Base Operations Services contract under the AbilityOne Program. The Court upheld the Agency’s decision to award the subject contract – which is worth approximately $71 million – to ServiceSource, Inc.

      Successfully represented the intervenor-awardee, Jacobs Technology Inc., in a GAO bid protest involving a $70 million task order awarded by the Department of the Navy, Naval Air Warfare Center Weapons Division, for information technology systems and services, primarily at China Lake and Point Mugu, California.

      Represented the protester, PIKA-PIRNIE JV, LLC in a GAO bid protest challenging the award of a task order issued by the U.S. Army Corps of Engineers for remedial excavation services. The Army Corps of Engineers took comprehensive corrective action in response to the protest that we filed.

      Successfully represented the protester, Integrated Nuclear Production Solutions, LLC, in a GAO bid protest involving the largest contract ever awarded by the U.S. Department of Energy – a $22.8 billion contract for the consolidation of management and operating activities at the National Nuclear Security Administration’s (“NNSA”) Y-12 National Security Complex, in Oak Ridge, Tennessee, and NNSA’s Pantex Plant near Amarillo, Texas.

      Successfully represented the intervenor-awardee, CH2M Hill, Inc., in a GAO bid protest in which the protester challenged the Defense Threat Reduction Agency’s evaluation of offerors’ technical and price proposals. The contract at issue, which is valued at approximately $11 million, is for services related to biological weapons threat reduction in Iraq and Afghanistan.

      Successfully represented the intervenor-awardee, Jacobs Technology, Inc., in a contentious bid protest before GAO. Among other things, the protester alleged that the Department of the Army engaged in flawed discussions with offerors and that the awardee possessed an organizational conflict of interest. The contract at issue, which is valued at approximately $50 million, is for a broad range of support services for the Army’s logistics civil augmentation program (“LOGCAP”).

      Successfully defended contract awarded to Fedcar Company, Ltd. in a bid protest action before GAO. The contract at issue was awarded by the Department of Veterans Affairs for the lease of a healthcare center in Fayetteville, North Carolina.

      Successfully represented the protester, Orion Technology, Inc., in a bid protest before the GAO. The contract at issue was a $280 million contract for installation support services at the U.S. Army Garrison--Redstone, Alabama.

      J.C.N. Construction, Inc. v. United States, 107 Fed. Cl. 503 (2012)
      Successfully represented construction contractor J.C.N. Construction, Inc. in bid protest action before the U.S. Court of Federal Claims. The contract at issue in that case involved replacement of HVAC system at the Old Post Office Building in Portland, Maine. This bid protest followed several successful agency-level protests.

The Agency took corrective action in response to the protest that we filed.

      Heros, Inc., B-292043 (2003)
      Involved the successful protest of an Army solicitation limiting helicopter engine repair bidders to the original equipment manufacturer and its authorized maintenance centers.

      Involved a successful Court challenge to the agency waiving past performance requirements for the low bidder after denial of the protest by GAO.

      Metcalf Construction Company, Inc. v. United States, CAFC No. 2013-5014 (2014)
      Successful representation of construction contractor, Metcalf Construction Company, Inc., in a high-profile appeal before the U.S. Court of Appeals for the Federal Circuit. Among other things, the case likely will set the standard for many years to come on the implied duty of good faith and fair dealing for federal government contracts.

      Moreland Corp. v. United States, 76 Fed. Cl. 268 (2007)
      Successfully represented client in action for wrongful default termination of government lease of a medical clinic in Las Vegas and award of approximately $18 million.

      Jacobs Engineering Group, Inc. v. United States, 434 F.3d 1378 (Fed. Cir. 2006)
      Successfully argued that contractor terminated for convenience was entitled to all of its costs reimbursable under the contract.

      Sterling Millwrights, Inc. v. United States, 26 Cl. Ct. 49 (1992)
      Successful representation of a contractor building a chrome-plating facility for the U.S. Army. The Court overturned a default termination and ruled our client was entitled to recover damages caused from the government's defective design and delays.

      Successfully represented the Intervenor-Awardee, Jacobs Technology Inc., in a U.S. Court of Federal Claims bid protest challenging the U.S. Department of the Air Force’s evaluation and award of a contract for support of the Air Force Wideband Enterprise Terminals Program, which is a $1.3 billion program that provides worldwide satellite communications to support military missions of the United States and Coalition forces.
