Stewart handled hundreds of litigation matters for banks, mortgage servicers, credit card companies, payment processors and other financial companies. His experience included mortgage foreclosure and other lender liability actions, check fraud and other UCC cases, credit reporting, D&O claims, letter of credit injunction cases and insurance coverage disputes.

In lending cases, Stewart represented lenders against claims involving loan commitments and modifications, mortgage servicing issues, swap agreements, assignments and collection activity. He worked to resolve numerous commercial loans secured by real estate and other investment assets. When collection action was needed, Stewart represented lenders in suits on injunction proceedings and other remedial actions. His experience also included demands and claims from other lenders that presented indemnity, re-purchase and allocation issues, as well as disputes over the priority of mortgages and other collateral.

Stewart handled a number of bank employee fidelity issues. His experience included internal investigations, working with law enforcement, indemnity claims under financial institution bonds and third party litigation.

Trial experience was a significant part of Stewart’s background in the financial services litigation arena. He tried a number of cases to a jury verdict in state and federal courts.
