Smithsonian Institution, CBCA 2862, et al., 2017 WL 1968758 (2017) Represented general contractor through trial on a complex design-build renovation of the National Museum of American History. BE&K Building Group, LLC v. Lorton Arts Foundation (E.D. Va.) Represented general contractor in federal court action arising from the conversion of the former Lorton Correctional Facility into an arts center. CHT Construction Company, LLC v. Diamond Alexandria, LLC Represented general contractor in parallel federal and state court actions arising from construction of large condominium project in Virginia; recovered more than $4 million using mechanic’s liens pursued in the developer’s subsequent bankruptcy proceedings. Centex Construction v. Acstar Insurance Co., 448 F.Supp.2d 697 (E.D. Va.) Represented general contractor against electrical subcontractor’s performance bond surety arising from construction project for the Army Corps of Engineers; obtained summary judgment in which the court rejected the surety’s “cardinal change” defense as a basis for denying coverage. John J. Kirlin, Inc. v. Diplomat Properties, LP (Florida) Represented mechanical subcontractor in multimillion-dollar arbitration proceedings arising from construction of large hotel and resort project in Miami, Florida. M and O Marine, Inc. v. J.A. Jones Construction Company (USDC PA) Represented general contractor in federal court against claims by excavation subcontractor arising from construction of a new lock at the Point Marion Lock and Dam near Pittsburgh, Pennsylvania; obtained summary judgment on civil RICO and common law fraud claims and successfully asserted delay and extra work claims against subcontractor in subsequent bench trial. Moreland Corporation v. RMA, Inc. (USDC Nevada) Represented owner/developer in multi-party action against its construction manager and subcontractors arising from construction of hospital clinic leased to Department of Veteran Affairs. Fireman’s Fund Insurance Company v. General Services Administration (GSBCA) Represented performance bond takeover surety in complex, multi-party ADR proceedings with GSA arising from the construction of a new 17-story federal courthouse and renovations to an adjacent historic post office in Brooklyn, New York. The Resort at Summerlin v. J.A. Jones Construction Company (USDC Nevada) Represented general contractor in parallel multi-party federal and state court actions arising from construction of large hotel and resort project. Hampton Roads Naval Housing project (Virginia) Represented general contractor in complex arbitration and mediation arising from construction of the Hampton Roads Naval Enlisted Housing PPV complex in Hampton Roads, Virginia, consisting of a six-story, Naval housing structure with approximately 750 units. Harbor Court Associates v. Kiewit Construction Company (USDC MD) Represented general contractor in defense of construction defect claims by developer and condominium association arising from construction of high-rise, mixed-use condominium project in Baltimore, Maryland.
