Consumer lending Advised a bank on the permissibility of making small-dollar loans at the rate of finance charge allowed to be charged by licensed small loan companies. Advised regional bank in its evaluation of proposed new multi-state loan documentation and compliance software offered by a major software vendor. Deposit operations Advised bank in designing a new checkless “second chance” deposit account with no non-sufficient funds (NSF) fee and drafted a supplement to the deposit agreement for the account. Advised regional bank regarding its policy for posting checks and other debits to transaction accounts and revised the bank’s order-of-posting and NSF fee disclosures. Bank regulatory/M&A Advised state-chartered FDIC-insured bank in a transaction in which a federally insured credit union purchased the major part of the bank’s assets and which transaction required approval of four financial institution regulators – state superintendent of banks, FDIC, state credit union administrator, and NCUA. Suspicious Activity Reports (SARs) Advised banks on the SAR reporting requirements applicable to specific fact situations. Online and mobile banking Led the Bradley team that advised a regional bank as the bank switched software platforms for its online and mobile banking products and revised the bank’s online and mobile banking agreements, including new agreements for person-to-person (P2P) payments and business-to-business (B2B) payments.
