Crowe Construction v. Jeffrey M. Brown, 264 F.Supp.2d 217 (E.D. Pa. 2003) Federal Court bench trial in Philadelphia; set aside unfavorable arbitration award against general contractor by proving evident partiality by two arbitrators. Kvaerner Pulping v. Air Flow Technologies Two week jury trial in Charlotte, North Carolina; obtained favorable verdict for boiler tube manufacturer against deceptive trade practices, fraud and breach of contract claims by boiler tube distributer. Arnold Construction v. Hanover Ridge Week long arbitration in Columbia, South Carolina between low income housing developer/bank and general contractor involving extra work and delays claims by the general contractor; obtained favorable result for the developer/bank. In re McShane, 2006 WL 4667136 (Bktcy. D. Md. July 27, 2006) Week long bench trial in federal bankruptcy court in Baltimore, Maryland, involving delay and inefficiency claims by a mechanical subcontractor against a general contractor, arising out of a peak shaving power plant project in Chesapeake, Virginia; obtained verdict in favor of mechanical subcontractor. USF&G v. Truswal Week long jury trial in the Circuit Court for Jefferson County, Alabama, involving construction defects at an apartment complex in Alabama; obtained defense verdict for a truss plate manufacturer who was allegedly responsible for trusses that failed. Capstone Development v. Universal Constructors Three week long arbitration, Eleventh Circuit Appeal, and bench trial involving delay and extra work claims between a developer and a general contractor, arising out of a multi-family project in Urbana, Illinois; obtained substantial verdict in favor of developer against general contractor and its surety. WPPSS vs. PDM Two week long jury trial in federal court, in Spokane, Washington involving almost $100 million in alleged cost overruns incurred to retrofit a nuclear power plant containment vessel in Hanford, Washington; obtained defense verdict for the general contractor. In re Caddell Construction, B-298949, 2007 C.P.D. 24 (Comp. Gen. Jan. 10, 2007); B-298949.2, 2007 CPD 119 (Comp. Gen. June 15, 2007) Filed successful bid protest with Government Accountability Office, alleging that contractor awarded U.S. Embassy in Djibouti was not a “United States person” eligible to construct an embassy under the Omnibus Diplomatic Security and Antiterrorism Act of 1986, 22 U.S.C. § 4852 (2000).
