Bradley's Renewable Energy team is composed of attorneys with experience in every phase of utility-scale solar development, from conception to generation and off-take. Our multidisciplinary team also helps clients in other major renewable energy areas, including wind, hydroelectric, and biomass.

Through our deep understanding of the multifaceted legal and business issues facing owners, developers, and financers, we protect our clients' business interests, manage risk, and keep viable projects moving forward on the path to success. We partner with our clients throughout each phase of renewable project development, and are ready to assist in the unfortunate event that litigation arises.

At the pre-development stage, we assist key stakeholders by identifying the risk factors that may interfere with the ability to attract private financing, including areas such as market and demand indicators, operational issues, technology performance, and regulatory matters. Involving the Bradley Renewable Energy team at the beginning of a project makes it possible to bring to the forefront and address potential issues before the client invests significant time and money.

Bradley’s Renewable Energy team works with clients to mitigate risks and bring them to a level that their tolerance dictates. Our multidisciplinary team includes tax attorneys who are well versed in:

  • Structuring entities to comply with and leverage state and local tax requirements
  • Interpreting and applying state and federal law to minimize clients’ tax burdens
  • Identifying and using state and federal tax incentives for a positive impact on operating costs for years to come

Our energy attorneys help clients establish the right locations with appropriate access, rights, and export characteristics – all essential for project viability and attracting initial investment. At the onset of this project milestone, the Bradley Renewable Energy team is on location, advising on real estate matters, including negotiating and drafting:

  • Long-term ground leases and access
  • Transmission and utility easements
  • Environmental assessment and permitting
  • Compliance and impact reviews
  • Permitting for construction and operations
  • Interconnection requirements

Our Renewable Energy team assists clients during the negotiation of the sale of a project’s output, preparation of PPAs and SREC purchase agreements.

We have extensive experience in all phases of construction for solar energy facilities, from selecting EPC contractors, contract negotiations, and documentation – including warranties, guarantees, and performance requirements – to settling disputes during or after project construction.

In connection with our nationally recognized construction practice, Bradley’s insurance coverage lawyers devote significant time to construction coverage advice and disputes, including emerging issues that affect the solar power industry. We regularly handle Comprehensive General Liability (CGL) disputes. Although construction claims are rarely simple, Bradley’s team manages these challenges effectively. For instance, our team recently convinced a complex market of insurers to fully fund a multimillion-dollar settlement on a solar project in Florida.

We leverage the skills of a multidisciplinary group of attorneys who understand the complexities of financing solar projects. We represent developers, contractors, utilities, lenders, and investors in structuring and negotiating these finance transactions to ensure that the effective monetizing of facilities and output yields the greatest return on investment for each stakeholder.

The Bradley Renewable Energy team handles ongoing representation of solar developers, owners, operators, and EPC contractors in all stages of project development, including real estate acquisitions, due diligence, and permitting and zoning compliance. We also offer advice regarding key project documents, such as:

  • PPAs
  • Interconnection agreements and EPC contracts
  • State and federal regulatory matters
  • Tax incentives
  • Project finance
