Bradley’s Data Centers team is composed of attorneys with experience across all phases of data center development and construction. Our experience in data center work ranges from hyper-scale facilities to colocation leases and renovations and everything in between. Bradley has partnered with some of the largest data center developers in the country to assist clients in all aspects of contracting, including issues with permitting and siting, as well as negotiation of EPC agreements, design-build agreements, professional services agreements, and master supply agreements. We also have had the opportunity to represent contractors and suppliers on these projects helping to negotiate their agreements, providing advice on project administration, and aiding them in resolving disputes.
Data center projects present unique challenges that Bradley’s team is well-positioned to tackle. The significant scale and short timeline for many of these projects can complicate development and construction. For example, given the heavy power demands for data centers, reliable access to the grid or alternative power sources is a priority, and the large size of these facilities and the expense of equipment installed inside require careful consideration of risk and indemnity allocations.
Drawing on experience from our nationally recognized and industry-leading Construction Practice Group, we are able to advise clients on all of these early project and contractual issues. If disputes arise, we also have a deep bench of talented construction litigators who are able to assist.
