Obtained pretrial dismissal of lawsuit seeking to set aside property transfers under the Alabama Uniform Voidable Transactions Act. Holmes v. Fresenius Kidney Care of Tuskegee, No. 3:21-CV-578-ECM, 2023 WL 8719447 (M.D. Ala. Dec. 18, 2023) Obtained summary judgment for dialysis provider in medical malpractice lawsuit.  Parks v. Centurion of Florida, LLC, No. 3:19-CV-631-MMH-PDB, 2023 WL 3947897 (M.D. Fla. June 12, 2023); Rogers v. Centurion of Florida, LLC, No. 3:20-cv-00725-MMH-MCR (M.D. Fla. Mar. 1, 2023) Obtained dismissal of healthcare providers based on plaintiffs’ failures to exhaust administrative remedies in lawsuits alleging violation of prisoners’ civil rights.  Ward v. Centurion Health, Case No. 6:21-cv-01887-PGB-DCI (M.D. Fla. Jan. 31, 2023) Obtained Rule 12(b)(6) dismissal of healthcare provider accused of deliberate indifference to a prisoner’s serious medical needs.  Hamze v. Jackson, Case No. 3:21-cv-565-MMH-JBT (M.D. Fla. Nov. 15, 2022) Obtained dismissal of nurse based on improper service in case alleging deliberate indifference to a prisoner’s serious medical needs.  Reed v. Dec. 3, 2021) Served as lead attorney in obtaining affirmance by the Alabama Supreme Court of trial court’s summary judgment dismissal of premises liability lawsuit against a car dealership.  Darty v. Cedar Lake Mining, Inc., Circuit Court of Jefferson County, Alabama (Birmingham Division), Case No. CV-2017-408 (July 31, 2020, Order, Doc. 152) Obtained summary judgment dismissal of breach of contract, fraud, and unjust enrichment claims against a coal mine and one of its executives.  Obtained favorable pre-litigation settlement of Alabama Deceptive Trade Practices Act claims arising out of boat dealership’s failure to disclose and satisfy an outstanding mortgage of $277,159 and other liens prior to the sale of a used boat. Represented 71 former tenants of the Metropolitan Apartment Complex in a lawsuit arising out of a fire and subsequent eviction, which resulted in a favorable confidential settlement. Represented a Switzerland-based manufacturer of metal bending machine in personal injury and product liability lawsuit in Lauderdale County, Alabama. Represented the distributor of concrete sealant products in product liability lawsuit in Tuscaloosa County, Alabama.
